The day-to-day occupier of a building has much of the responsibility under health and safety law. Even if there is an element of the building which is unsafe and is the responsibility of the landlord, for example the existence of a damaged stair tread with the consequential risk of a person falling, the employer who invites staff to come into that building to work is primarily responsible for the health and safety of those staff. However, the landlord will have responsibilities specified under the terms of the lease or rental agreement and it is the occupier's/leaseholders/tenant's duty to press the landlord to discharge those responsibilities in a proper manner. Ultimately, however, the provision of a safe place of work is a legal obligation placed on the employer.
As well as the basic key regulations and Statutory requirements, we aim to provide content that is specific to leisure based activities. All areas however should first be identified and risk assessed and hazards identified. Risk assessment is the first point of call for all good health and safety management.
